Friday Night Videos: British Invasion Edition
But first, the week's advertising and business news:
Bank of America will use commercials during Sunday night's broadcast of the Academy Awards show to roll out its new marketing campaign.

The company has adopted the slogan "Bank of Opportunity" ... The new tag line replaces the bank's four-year-old slogan "Higher Standards."

-Associated Press, 2/23/07

Federal authorities say they have exposed one of the most far-reaching insider-trading schemes on Wall Street in decades, an investigation that includes a Bank of America Corp. employee.

According to The New York Times, 13 individuals have been accused of taking part in the alleged trading ring. Along with the BofA employee, they include a former Morgan Stanley compliance official, a senior UBS research executive and three workers from Bear Stearns.

Nine suspects have been arrested, and four have pleaded guilty to charges ranging from securities fraud, conspiracy to commit securities fraud and bribery.

-Sacramento Business Journal, 3/2/07
As a connoisseur of corporate malfeasance I'm glad to see that the Enron debacle did nothing to dampen the can-do spirit of America's business class. Keep earning, people!

And now, this weeks videos, wherein we jump back in time and across the pond.

There, I said it.
Joe Strummer was a god. He's totally on my list of "guys I'd go straight for" (except, like Bolan, he had to go and die on us).

(For the record, Urbaniak gets his man-sexy on for "Alan Greenspan, Peabo Bryson, the fat guy from 'Head of the Class' and Guy Kibbee".)

Neat assortment of videos this week(I lean towards the Clash and the Buzzcocks)

I've been a little surprised at how little coverage the SEC bust seemed to have gotten so far, but it has been a busy week in terms of stories: everything from the Walter Reed debacle, a stock market hiccup, revelations that the North Korean uranium enrichment program seems rather doubtful, among other incidents great and small like the recent celebrity funeral. I suppose that while it's a challenge to keep tabs on current events in the interesting times we live in, it's rarely dull. Often exasperating, but not dull.

PS. Was one of them Brian Eno? Working class hero whos Eton educated son was recently arrested in The House of Commons after bursting into the House to protest the banning of fox hunting.

Also, thumbs up for the Gang of Four. "Love crops up quite a lot as something to sing about, cos most groups make most of their songs about falling in love or how happy they are to be in love, you occasionally wonder why these groups do sing about it all the time - it's because these groups think there's something very special about it either that or else it's because everybody else sings about it and always has, you know to burst into song you have to be inspired and nothing inspires quite like love. These groups and singers think that they appeal to everyone by singing about love because apparently everyone has or can love or so they would have you believe anyway but these groups seem to go along with what, the belief that love is deep in everyone's personality. I don't think we're saying there's anything wrong with love, we just don't think that what goes on between two people should be shrouded with mystery."

Mr. Urbaniak...

This week, my fellow law students and I attended a trial advocacy competition featuring law schools from across the country.

When the guest judge walked into the room, I screamed, "Holy shit! That's James Urbaniak!"

Yet, it got cooler--it turns out the dude didn't HAVE A HAND!!! It was one of those fleshy stumps! Seriously, it was awesome.

Then the guest judge walked into the room, I screamed, "Holy shit! That's James Urbaniak!"

Did the judge then glare at you and say "One more outburst like that, counselor, and I'll hold you in contempt."

Nah! I knew to whisper it to my co-counsel as he strolled into the room. And "Stumpy Urbaniak" gave us the win!

Seriously, we had a cavalcade of celebrity guest judges. We made it to the semi-finals and our judge was none other than a dude who looked like Miguel Ferrer. But not "Robocop" era Ferrer... it was more like "Crossing Jordan" era Ferrer.

He did not give us the win.

"Used Car Salesman" is probably down in the teens somewhere around "Jukebox Plugger" or "Record Company A&R Man." Their professions are evil but impact relatively few people.

"Fascist Despot" falls under "politician." Didn't used to, does now, at least in this country.

I don't know all the details of this particular case, but in general, I have trouble accepting the basic concept of "insider trading," or trading based on superior knowledge, as a crime.

If a corporate officer has violated the specific terms of his employment by not disclosing whatever "insider" information he may have, then he should be prosecuted for breach of contract. But I don't see how trading one's own shares in a voluntary agreement, regardless of either party's superior or inferior knowledge, can be criminal. Who are the victims?

(Reply to this) (Thread)

[info]urbaniak
2007-03-06 12:51 am UTC (link)
I'll defer to my readers with business degrees but my understanding is that since SEC law states that all trades must be based on publicly available information, the victims of insider trading are shareholders and other investors.

That's sort of my understanding too, and purely from that basis, it just seems a poor justification to charge someone for knowing more than someone else.

More Advertising News...

Complaints Filed Over "Gay" Super Bowl Ads
The Snickers ad that ran during last month's Super Bowl in which two mechanics munching at each end of a candy bar end up mouth to mouth and then register their disgust, offended not only gays but also religious conservatives, it turns out. The Smoking Gun website on Monday posted numerous complaints filed with the FCC over the ad. One wrote of feeling "violated" by the ad, writing "God knows, I didn't turn on the superbowl [sic] expecting to be tricked into watching gay sex." Another wrote that the spot violated "our religious beliefs and exposes our children to obscene and disgusting material they are taught are wrong." Other letter writers complained about Prince's performance during halftime likening it to gay porn. In all, the FCC received about 150 complaints about the telecast -- a far cry from the tens of thousands of letters that rained down on the commission in the wake of the Janet Jackson "Nipplegate" scandal three years ago.

That homophobe apparently does not event have the remotest idea about what gay sex involves.
